Terms of Service

By creating a FinNudge account or using any part of the Service, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use FinNudge. These Terms constitute a binding legal agreement between you and FinNudge (“we,” “our,” or “us”).

To use FinNudge you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction).
• Be a human individual. Accounts registered by bots or automated methods are not permitted except via our official API.
• Have the legal authority to enter into these Terms on behalf of yourself.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and current information when registering.
• Notify us immediately at sharvee@finnudge.money if you suspect unauthorised access to your account.
• Not share your password with any third party.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

FinNudge provides personal finance tracking tools including bank account linking (via Plaid), transaction categorisation, budget management, savings goal tracking, recurring subscription detection, and spending trend analysis.

Read-only access only. FinNudge connects to your financial accounts in read-only mode. We cannot and will not initiate payments, transfers, or any changes to your financial accounts.

Not financial advice. The information, insights, and notifications provided by FinNudge are for informational purposes only and do not constitute financial, investment, tax, or legal advice. Always consult a qualified professional before making financial decisions.

Data accuracy. Transaction data is sourced from your financial institutions via Plaid. We cannot guarantee the accuracy or completeness of this data and are not responsible for errors or omissions by your financial institution or Plaid.

FinNudge offers three tiers:

• Spark (Free) — core budgeting features with limited account connections.
• Plus — additional account connections, CSV export, and monthly email reports.
• Pro — full feature access including advanced analytics and priority support.

Paid subscriptions are billed monthly or annually in advance via Stripe. All payments are non-refundable except where required by law or at our sole discretion. You may cancel at any time; your subscription remains active until the end of the current billing period.

We reserve the right to change subscription pricing. We will provide at least 30 days' notice of any price increases by email.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorised access to any part of the Service or to other users' data.
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service.
• Use the Service to transmit malware, spam, or any content that is harmful, fraudulent, or deceptive.
• Scrape, crawl, or otherwise extract data from the Service except through officially provided APIs.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.

The FinNudge name, logo, website, and all associated software, content, and designs are the exclusive property of FinNudge and are protected by copyright, trademark, and other intellectual property laws.

Your data. You retain ownership of your financial data. By using the Service you grant FinNudge a limited, non-exclusive licence to process your data solely as described in our Privacy Policy.

The Service integrates with third-party providers including Plaid (bank connectivity), Stripe (payments), and Resend (email). Your use of these third-party services is subject to their respective terms of service and privacy policies. FinNudge is not responsible for the practices, availability, or content of third-party services.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any loss of data resulting from transmission errors, service interruptions, or other causes beyond our reasonable control.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINNUDGE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless FinNudge and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

You may stop using the Service and delete your account at any time via Settings → Account → Delete Account.

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) will do so.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware. If you are located outside the United States, you consent to the transfer of your data to and processing in the United States.

We may revise these Terms from time to time. We will notify you of material changes by email and by updating the “Last updated” date above. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
